AN ORDINANCE  TO WAIVE COMPETITIVE  BIDDING  AND  AUTHORIZE PURCHASE OF 100,000 CUBIC YARDS OF  FILL DIRT FOR THE MUNICIPAL LANDFILL TO BE MOVED FROM THE CONSTRUCTION SITE OF THE  NEW WAL-MART SUPERCENTER, SOUTH OF HIGHLAND, EAST OF BROWN’S LANE.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: That the Sanitation Department needs to purchase the following: 100,000 cubic yards of fill dirt for the Municipal Landfill.

 

SECTION 2: That such fill dirt can be purchased from the construction site of the new Wal-Mart Supercenter, south of Highland, east of Brown’s Lane for the sum of $125.000 total, to be paid upon completion of delivery.

 

SECTION 3: That the City Council, in accord with the terms of A.C.A.  14-58-302 (2) (b) hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described for the price set forth in SECTION 2 above.  Said amount shall be paid by money from the Sanitation Materials line item in the Sanitation Department Budget.

 

SECTION 4: It is further found that due to the immediate need to acquire the above fill dirt, and emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its approval.

 

PASSED AND ADOPTED this 1st day of July, 1991.
