AN ORDINANCE TO ESTABLISH REQUIRED RIGHT-OF-WAY FROM MADISON STREET SOUTH FROM BURKE AVENUE TO NETTLETON AVENUE AND FOR OTHER PURPOSES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: That the Code of Ordinances of the City of Jonesboro, Arkansas, is hereby amended by adding a sub-paragraph to Section 20-82, sub-paragraph B to be numbered (22), which said sub-paragraph shall read as follows:

 

(a) Madison Street South from Burke Avenue to Nettleton Avenue will require a right-of-way of 60’, and the provisions of this ordinance respecting buildings shall apply 30’ from said line or from the center line of the highway, street or road designated.

 

Section 2: All ordinance and or parts of ordinances in conflict herewith are hereby repealed.

 

Section 3: It is found and declared by the City Council that the present requirements for right-of-way on Madison Street south from Burke Avenue to Nettleton Avenue is excessive and is no longer needed for Municipal purposes, and the reduction of the required right-of-way to 60’ will inure to the benefit of the property owners along Madison Street and to the City; and that therefore, this Ordinance being necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist and this Ordinance shall take effect from and after its passage and approval.

 

PASSED and ADOPTED this 16th day of August, 1976.
