ORDINANCE TO VACATE AND ABANDON AN UNIMPROVED TEN (10') FEET UTILITY EASEMENT AND ALL OF THE UNIMPROVED STREET RIGHT OF WAY OF CRESTFIELD COVE

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
 
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights together with the rights of the public generally in and to the unimproved utility easement and unimproved street right of way designated as follows:
 
The west 10' of Lot 12, the Southeast 10' of Lot 13, the South 10' of Lot 14, and the East 10' of Lot 15 Block 'G' (all being adjacent to the street right of way of Crestfield Cove) and the unimproved street right of way of Crestfield Cove of Woodland Heights Subdivision Phase V in the City of Jonesboro, Craighead County, Arkansas.
 
SECTION 2: A copy of this ordinance certified by the City Clerk shall be filed in the office of the Recorder of Craighead County, Arkansas, and shall be filed in the Deed Records of such office.
 
SECTION 3: The City Council of the City of Jonesboro, Arkansas, finds and declares that the above unimproved utility easement and unimproved street right of way is not necessary for the general benefit and welfare of the public; that the owner's of all the property abutting the above unimproved utility easement and unimproved street right of way is in favor of the closure and vacation of the above unimproved utility easement and unimproved street right of way and that therefore an emergency is declared to exist and this ordinance shall take effect and be in full force from and after its passage and approval.
 
APPROVED AND ADOPTED this 4th day of January, 2005.
