AN ORDINANCE TO AMEND THE CODE OF ORDINANCES AND ADD SECTION 50-27 TO PARK RULES TO PREVENT CAMPING OUTSIDE DESIGNATED CAMPING LOCATIONS WITHIN CITY PARKS AND CITY PARKING LOTS IN THE CITY OF JONESBORO

WHEREAS, the City Council of the City of Jonesboro, Arkansas desires to ensure our parks and parking lots remain clean and safe for the citizens; and

 

WHEREAS, the City Council recognizes that camping outside of designated camping areas in city parks or parking lots may impede the use and enjoyment of the parks for the citizens; and

 

WHEREAS, the language contained in Section 50-27 should be added to the Code of Ordinances and shall be so codified.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:

 

That the following language shall be added to the Code of Ordinances in Chapter 50, Article II, Section 50-27 and shall read as follows:

 

(a) No person shall camp in any city park or city owned parking lot unless they are located in a designated camping area.

 

(b) Camping means the erecting of a tent or shelter of natural or synthetic material, or preparing a sleeping bag or other bedding material for use, for the apparent purpose of overnight occupancy.

 

(c) Any law enforcement or code enforcement officer in the City of Jonesboro may enforce this ordinance by removing the person in violation hereof and their belongings from the prohibited area.

 

(d) Violation of this ordinance may be punishable by a fine of not less than $100 for the first violation of this ordinance.

 

(e) Nothing in this chapter shall prevent the City from granting permission to camp in a restricted area during a special event.
