AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF A 2007 KOMATSU EXCAVATOR

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
SECTION 1: That the City of Jonesboro Street Department needs to purchase a 2007 KOMATSU EXCAVATOR PC228USLC, SN 40337.
SECTION 2: That said excavator can be obtained from EQUIPMENT CONNECTIONS, 5707 COMMERCE SQUARE, JONESBORO, AR 72402, at a cost of $102,500 less trade-in allowance of $10,500 for a 2000 Kobelco 250 excavator and $5,050 for a 1993 Caterpillar pneumatic roller for a final cost of $86,950.
SECTION 3: That the KOMATSU PC228USLC EXCAVATOR best meets the needs of the Street Department and the Public Works Committee recommends the purchase of said excavator.
SECTION 4: That money for the purchase of said excavator shall be appropriated from the Street Department Fixed Asset account 02-100-0232-00.
SECTION 5: That the City Council in accord with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described for the price set forth in Section 2 above.
SECTION 6: It is further found that due to the immediate need to acquire this equipment, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health, and safety shall take effect from and after its passage and approval.
