RESOLUTION DECLARING A VACANCY ON THE JONESBORO CITY COUNCIL AND ESTABLISHING A PROCEDURE FOR FILLING THE COUNCIL VACANCY

WHEREAS, Alderman Jimmy Ashley submitted his resignation from the Jonesboro City Council, Ward 6, Position 2, effective December 31, 2006;
WHEREAS, Arkansas Code Annotated Sec. 14-43-411, supported by legal opinions from the City Attorney of the City of Jonesboro, and the Attorney General for the State of Arkansas, requires that when a vacancy occurs on the city council in a city of first class which elects its alderman at large, the city council shall elect the new council member;
WHEREAS, the Nominating and Rules Committee of the Jonesboro City Council has recommended a procedure for selecting the new council member.
IT IS THEREFORE RESOLVED that a vacancy has occurred on the Jonesboro City Council, Ward 6, Position 2, effective December 31, 2006, and it is the responsibility of the city council to fill the vacancy in accordance with A.C.A. Sec. 14-43-411;
IT IS FURTHER RESOLVED that any citizen of the City of Jonesboro residing in Ward 6, who shall acquire the signatures of not less than 30 registered voters of the City of Jonesboro on an official election petition; who shall complete a Statement of Financial Interest form and additional financial disclosure information as required by the Jonesboro City Council Rules and Procedures; who shall complete a Political Practice Pledge; and who shall complete a one-page, typewritten statement of qualifications and reasons for serving on the Jonesboro City Council; all submitted to the City Clerk of the City of Jonesboro, no later than 10:00 a.m. on Thursday, February 1, 2007, shall be considered for election;
IT IS FURTHER RESOLVED that if there are more than five (5) applicants the Nominating and Rules Committee will select the top five (5) to recommend to the Jonesboro City Council for selection; if the number is equal to or less than five (5) all of the applications shall be pr...
