AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF POLICE AND EMERGENCY SIRENS AND OTHER EQUIPMENT

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
 
SECTION 1: That the Police Department needs to purchase 9 Electronmechanical Sirens, 9 Controller with Radios, 9 Tone Coded Decoders, 9 Antennas, and 9 Coaxial Cables, with the contractor providing all materials, and equipment, in accordance with manufacturing recommendations.
 
SECTION 2: That such emergency sirens, radios, decoders, antennas and cables may be purchased from D H Marketing Company, 6015 Lohmann's Crossing, Suite 101, Lago Vista, Texas 78645, Tip Foreman, Sales Representative, for the sum of $71,848.00.
 
SECTION 3: That the City Council in accord with the terms of A.C.A. 14-58-302 (2) (B) hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described work for the price set forth above.  Said amount shall be paid from the Equipment Line Item in the Police Department budget.
 
SECTION 4: Whereas, it is found that D H Marketing Company is the sole known source of the equipment needed, and that the conditions of the city are such that the safety of the citizens of Jonesboro may be in jeopardy, and an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect from and after its passage and approval.  
 
PASSED AND ADOPTED this 1st day of August, 1994.
