BILL FOR AN ORDINANCE ENTITLED: AN ORDINANCE TO VACATE AND ALLEY RUNNING EAST AND WEST THROUGH BLOCK 9 OF MATTHEW’S ADDITION TO THE CITY OF JONESBORO, ARKANSAS.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas.
WHEREAS, a petition was duly filed with the City Council for the City of Jonesboro, Arkansas on the 8th day of November, 1948, asking the City Council to vacate and abandon an alley running East and West through Block 9 of Matthew’s Addition to the City of Jonesboro, Arkansas as the same appears in Plat Book 5, page 500 in the Office of the Recorder of Craighead County, Arkansas, said alley being more particularly described as follows:
Beginning at the Southeast corner of Lot 1 of said Block 9, thence West to the Southwest corner of Lot 6, thence South to the Northwest corner of Lot 7, thence East to the Northeast corner of Lot 22, thence North to the point of beginning being as strip of land 300 feet East and West, and 20 feet North and South, lying and being situated in Block 9 of Matthew’s Addition to the City of Jonesboro, Arkansas.
And;
WHEREAS, after due notice required by law the City Council has at the time and place mentioned in said notice heard all persons desiring to be heard on the question and has ascertained that said alley as above described has heretofore been dedicated to public use as an alley; has not been actually used by the public generally for a period of more than five years; that all the owners of property abutting upon said alley have filed with the Council their written consent for such abandonment; that the public interest and welfare will not be adversely affected by the abandonment of such alley.
NOW, THEREFORE, BE IT ORDAINED by the City Council of Jonesboro, Arkansas;
SECTION 1. The City of Jonesboro, Arkansas, hereby release, vacates and abandons all its rights, together with the rights of the public generally in and to the alley designated as follows:
