Ordinance authorizing a city employee to do business with the City of Jonesboro, Arkansas
Body
Whereas, Arkansas Code Annotated 14-42-107 provides that interest in office or contracts is prohibited by any alderman, council member, official, or municipal employee; and
Whereas, federal administrative law 24CFR 570.611 "prohibits persons who exercise or who have exercised any functions or responsibilities with respect to CDBG... or who are in the position to participate in a decision making process or to gain inside information with regard to such activities, may obtain a financial interest or benefit from an assisted activity...either for themselves or those whom they have family or business ties, during their tenure or for one year thereafter; and
Whereas the CDBG (Community Development Block Grant) program application for public services includes a conflict of interest statement for all applicants; and
Whereas, Emma Agnew is both a city employee and the City's NJNI (North Jonesboro Neighborhood Initiative ) Coordinator; and
Whereas, NJNI has applied and has been tentatively approved (pending Council approval) for FY 2014 CDBG public service funds in the amount of $20,000 to be utlized to further the mission of the NJNI; and
Whereas, special permission must be granted by the Jonesboro City Council of Jonesboro, Arkansas for North Jonesboro Neighborhood Initiative to receive CDBG public service funds.
NOW, THEREFORE, BE IT ORDAINED by the City Council of Jonesboro, Arkansas that:
Section 1: The City Council for Jonesboro, Arkansas has been made aware of the above mentioned application from NJNI of which Emma Agnew (city employee) is the Coordinator, and gives special permission for NJNI to apply, receive, and utilize CDBG public service funds to futher the mission of NJNI.
