AN ORDINANCE TO AMEND SECTIONS 14.08.13 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS TO ELIMINATE THE REQUIREMENT OF CURBS AND GUTTERS IN I-2 ZONING; TO DECLARE AND EMERGENCY

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: Subsection 8 of Section 14.08.13 (c) of the Code of Ordinances of the City of Jonesboro is hereby amended by the addition of the following language:
"Curbs and gutters shall not be required for street plans in this district, when the land being planned consists of 35 acres or more and the lot size is 3 acres or more; however, the plan must provide for proper drainage and rights of way."
SECTION 2: It is found and declared by the City Council that preparation of property to be offered for sale to new or expanding industrial prospects is being hampered by the current requirement of curbs and gutters in i-2 general manufacturing districts, and this Ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage and approval.
