A RESOLUTION OF THE CITY OF JONESBORO, ARKANSAS AUTHORIZING A SETTLEMENT ON THE JIMMY ASHLEY VS. CITY OF JONESBORO LAWSUIT

WHEREAS, the City of Jonesboro, was sued by Jimmy Ashley in a lawsuit alleging a lack of compliance with the Americans with Disabilities Act as it applies to various bus stops on the JETS transit service; and
WHEREAS, the parties have participated in extensive review and negotiations regarding the bus stops in the City of Jonesboro; and
WHEREAS, the City of Jonesboro believes it is in compliance with its federal guidelines, but acknowledges that there are bus stops currently which are not ADA compliant; and
WHEREAS, a proposed settlement was reached, subject to the approval of the Jonesboro City Council.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:
1. The City of Jonesboro shall settle the pending litigation referenced above for the total sum of $12,000.00 in attorney's fees and costs to be paid by the City of Jonesboro.
2. That the City of Jonesboro has agreed to a timeline to make all existing JETS bus stops ADA compliant and has further agreed to ensure all future permanent bus stops shall be ADA compliant within eighteen (18) months of the decision to locate a permanent stop at a location.
3. The Mayor, Harold Perrin and City Clerk, Donna Jackson are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate this agreement.
