BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, as follows:

ARTICLE
AMENDMENTS

SECTION 1: Article I (37) shall be amended to state as follows:

SECTION 37 “National Categorical Pretreatment Standard” or “Pretreatment Standard” shall mean any regulation containing pollutant discharge limits promulgated by the Environmental Protection Agency in accord with the Federal Water Pollution Control Act as amended by the Clean Water Act (as amended).

SECTION 38 “Significant Industrial User” shall mean: 1) All discharges subject to Categorical Pretreatment Standards under Paragraph 403.6 and 40 C F R Chapter I, Subchapter N; and 2) All noncategorical discharges that, in the opinion of the Control Authority, have a reasonable potential to adversely affect the POTW’s operation, or that contribute a process wastestream which makes up 5 percent or more of the average dry weather capacity of the POTW. Treatment plant or that discharges an average of 25,000 gallons per day or more of process wastewater to the POTW. However, the Control Authority need not designate as Significant any noncategorical Industrial User that, in the opinion of the Control Authority and with the agreement of the Approval Authority, has no potential for adversely affecting the POTW’s operation or for violating any pretreatment standard or requirement. The agreement of the Approval Authority is not necessary in cases where the noncategorical discharger would have been designated as significant only because of an average discharge o 25,000 gallons per day or more o...
