RESOLUTION TO ABANDON AN ALLEY CONNECTING WITH FALL STREET AND EAST MATTHEWS ROAD

WHEREAS, all of the property owners abutting upon a certain alley hereinafter described have filed with the City Council their petition requesting that the City enter into agreement to close and abandon said alley under authority of Ark. Stats. Anno. 19-3817,  which alley is described as being 20 feet in width running East and West through Block "C" of East Nettleton Second Addition connecting with Fall Street on the West and East Matthews Road on the East,  and
 
WHEREAS,  the Council finds that, although platted, the alley has never been improved or open for public vehicular travel;  that for approximately one-half of its length, both the North and South sides of such alley are under the same ownership;  that there are public streets both North and South of the said alley and within a reasonable distance therefrom which give adequate vehicular access East and West between Fall Street and East Matthews Road;  that some of the owners of property abutting on said alley have plans for improvements which are hindered by the existence of the alley and which, if put into effect,  would inure to the benefit of the City in general.
 
IT IS THEREFORE, RESOLVED by the City Council of the City of Jonesboro, Arkansas, that the Mayor and the City Clerk be, and they are hereby, authorized and directed to enter into a written agreement with the owners of all the real estate abutting upon said alley to close and abandon such alley which is hereby declared to be not needed for highway purposes and as to which it is hereby found that the welfare of the City will be enhanced and promoted by the closing and abandoning of said alley.  Further, that the agreement, after execution, may be properly recorded with the Circuit Clerk of this County and, in accord with law, title to the property so abandoned shall vest in the owners adjacent thereto.
 
PASSED AND ADOPTED this 6th day of May, 1968.
