AN ORDINANCE ABANDONING AND VACATING A PORTION OF THE MELROSE STREET RIGHT OF WAY

WHEREAS, the City Council at its regular meeting on May 1, 2000, pursuant to Ark. Stats. Section 14-301-302 through 14-301-304 heard the request of Archon Group to abandon a portion of the Melrose Street right of way; and
WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and
WHEREAS, all utility companies have consented to said abandonment; and
WHEREAS, the abandonment of said portion of the right of way of Melrose Street would not adversely affect any utility companies and would be in the best interest of all parties concerned.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas hereby vacates and abandons all of its rights together with the right of the public generally, in and to a portion of Melrose Street right of way, described as follows:
The West 15.0 feet of Melrose Street right of way lying adjacent to the Terrace Apartments Second Replat of a part of College Place Subdivision of Jonesboro, Craighead County, Arkansas, being more particularly described as follows: Begin at the Northeast Corner of Lot 97 of the College Place Subdivision of Jonesboro, Craighead County, Arkansas, thence North 89º35'00” East 15.00 feet; thence South 0º00'00? West 625.37 feet to a point on the North right of way of Johnson Avenue, being on a curve to the right whose radius equals 2,817.83 feet; thence along said curve (chord bears South 87º11’36” West 15.02 feet) a distance of 15.02 feet; thence North 0º00’00” East 626.00 feet to the point of beginning containing 9385.40 square feet, more or less, subject to all rights of way and easements of record.
SECTION 2: A copy of this Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County at Jonesboro, Arkansas, and recorded in...
