RESOLUTION OF THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS AUTHORIZING THE REIMBURSEMENT FOR PROFESSIONAL SERVICES AND DRAINAGE EASEMENT ACQUISITION FOR DITCH 26 (VINEY SLOUGH DITCH) TO THE POINSETT WATERSHED DISTRICT

WHEREAS, the City of Jonesboro, Arkansas and Craighead County and the Federal Government through Natural Resources agreed in 2003 to utilize federal funds to make certain improvements to Ditch 26, AND
WHEREAS, the Poinsett Watershed District and the Natural Resources Conversation Service, the City of Jonesboro and Craighead County, by and through their agents, were able to obtain most of the drainage easements without compensation, AND
WHEREAS, Imminent Domain proceedings were required to obtain a drainage easement from a landowner adjoining Ditch 26 in order for the federally funded project to proceed, AND
WHEREAS, the necessary drainage easement was obtained by the Poinsett Watershed District at a total cost of $21,715 (permanent easement $3,450; temporary easement $15,450; crop damage $1,575; Circuit Court filing fees $100; title fees $240; appraisal fees $900).
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Jonesboro, Arkansas that:
SECTION 1. The City of Jonesboro is hereby authorized to reimburse the Poinsett Watershed District in the amount of $21,715 for fees associated with the condemnation of a drainage easement adjacent to Ditch 26.
SECTION 2. The Finance Director is hereby authorized to pay $21,715 out of the Capital Improvement Fund, Account #7-100-152 to the Poinsett Watershed District, c/o Charles Frierson, P. O. Box 8007, Jonesboro, Arkansas 72403.
