AN ORDINANCE AMENDING TITLE 14, THE ZONING ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS, TO REQUIRE DESIGN PROFESSIONALS PREPARING SITE PLANS TO VERIFY THAT SITE IMPROVEMENTS HAVE BEEN INSTALLED AND COMPLETED IN ACCORDANCE WITH THE APPROVED SITE PLAN.

WHEREAS, the Metropolitan Area Planning Commission held a public hearing on July 8, 2003 concerning the proposal to require design professionals (registered civil engineers, landscape architects, and architects) preparing site plans under Section 14.44.02 of the Zoning Ordinance to verify that site improvements have been installed and completed in accordance with the site plan approved by the City Planner and/or the Metropolitan Area Planning Commission.
WHEREAS, all comments, views, suggestions and recommendations made at said public hearing have been considered and addressed by the Metropolitan Area Planning Commission; and,
WHEREAS, the Metropolitan Area Planning Commission voted five members for and one member against recommending to the Jonesboro City Council that the Zoning Ordinance be amended to require said verification.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
That Section 14.44.02 of the Zoning Ordinance is amended as follows:
The design professional (engineer, architect, or landscape architect) preparing and sealing site plans as prescribed under this section shall periodically inspect the construction of all site improvements shown on and required by the site plan approved by the City Planner and/or the Metropolitan Area Planning Commission and shall verify that, to the best of the design professional’s knowledge, all improvements have been constructed and completed in accordance with said plan. A letter verifying this fact shall be submitted to the City Planner prior to issuance of a Certificate of Occupancy.
