AN ORDINANCE APPOINTING COMMISSIONER FOR SEWER IMPROVEMENT DISTRICT NO. 2; CONFIRMING VARIOUS MATTERS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.

WHEREAS, Jonesboro Sewer Improvement District No. 2 was formed by Ordinance No. 2281, adopted and approved July 16, 1990, and the Commissioners (the members of the Board of Improvement) of the District were appointed in that Ordinance; and

 

WHEREAS, Mr. Fred Yawn has resigned as a Commissioner of the District; and

 

WHEREAS, the remaining Commissioners of the District recommend the appointment of Mr. Warren Moore to fill the vacancy created by the resignation of Mr. Fred Yawn and Mr. Warren Moore is a property owner in the District and is qualified to serve as a Commissioner of the District;

 

NOW THEREFORE BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: Mr. Warren Moore is hereby appointed to serve as a Commissioner of Jonesboro Sewer Improvement District No. 2, filling the position heretofore held by Mr. Fred Yawn.

 

SECTION 2: Mr.’s. David Burgess and David Doyle are hereby confirmed, ratified and appointed as Commissioners of Jonesboro Sewer Improvement District No. 2.

 

SECTION 3: All Ordinances and parts thereof in conflict herewith are hereby repealed to the extent of such conflict.

 

SECTION 4: The improvements for which the District was established are essential to the health and comfort of the inhabitants of the City and cannot be accomplished but for the action to be taken by the District. Therefore, an emergency is declared and this Ordinance, being necessary for the public peace, health and safety, shall be in effect upon its passage and approval.
