AN ORDINANCE TO VACATE AND ABANDON BIRCH COVE LOCATED IN MERRYWOOD SUBDIVISION TO THE CITY OF JONESBORO, ARKANSAS, AS REQUESTED BY RAY NICKLE

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas that:
 
SECTION 1:   The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the street designated as follows:
 
Birch Cove which is located in Merrywood Subdivision to the City of Jonesboro, Arkansas, as shown on the attached plat which is incorporated herein.  (Ray Nickle)
 
SECTION 2:   A copy of the Ordinance duly certified by the City Clerk shall be filed in the offices of the Recorder of Craighead County, Arkansas, and shall be filed in the Deed Records of such office.
 
SECTION 3:   The City Council of the City of Jonesboro, Arkansas, finds and declares that the above street is not necessary for the general benefit and welfare of the public; that the owners of all property abutting the above street are in favor of the closure and vacation of the above street.
 
SECTION 4:   The City Council further finds and declares that an emergency exists and this Ordinance is necessary for the preservation of public peace, health and safety and shall take effect and be in full force and effect from and after its passage and approval.
 
PASSED AND ADOPTED this 21st day of March, 1988.
