A RESOLUTION TO THE CITY OF JONESBORO, ARKANSAS TO ENTER INTO A PUBLIC HIGHWAY GRADE SEPARATED CROSSING IMPROVEMENT AGREEMENT

WHEREAS, the City of Jonesboro has desires to enter in a Public Highway Grade Separated Crossing Improvement Agreement with Union Pacific Railroad Company covering the rehabilitation of the existing Bridge Street Overpass Grade Separated Public Road Crossing;
 
WHEREAS, Union Pacific Railroad Company has submitted the attached agreement describing the services to be provided for the rehabilitation of the existing Bridge Street Overpass Grade Separated Public Road Crossing;
 
WHEREAS, Union Pacific Railroad Company requires an administrative handling fee in the amount of $1,000.00; and
 
WHEREAS, the funding for the administrative handling fee shall come from the 2012 Capital Improvement budget and compensation shall be paid in accordance with the agreement.
 
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:
 
Section 1.  That the City of Jonesboro shall enter into an agreement with Union Pacific Railroad Company to provide services for the rehabilitation of the existing Bridge Street Overpass Grade Separated Public Road Crossing;
 
Section 2.  The funding for the administrative handling fee shall come from the 2012 Capital Improvement budget and compensation shall be paid in accordance with the agreement.
 
Section 3.  The Mayor and the City Clerk are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate this agreement.
