AN ORDINANCE TO VACATE AND ABANDON UNIMPROVED PORTIONS OF TWO (2) FIFTEEN-FOOT (15') UTILITY EASEMENTS IN RAIDER VILLAGE, JONESBORO, ARKANSAS

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:

SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the utility easement designated as follows:

TRACT 1: A utility easement fifteen feet (15') in width, the north seven and one-half feet (7.5') of which is over and across the south side of Lot 10 and the south seven and one-half fee (7.5') of which is over and across the north side of Lot 11, all in Raider Village, Jonesboro, Arkansas, as shown by Plat recorded in Plat Book 179 at Page 25 in the office of the Circuit Clerk for the Western District of Craighead County in Jonesboro, Arkansas; and

TRACT 2: A utility easement fifteen feet (15') in width, the north seven and one-half feet (7.5') of which is over and across the south side of Lot 16 and the south seven and one-half feet (7.5') of which is over and across the north side of Lot 17, all in Raider Village, Jonesboro, Arkansas, as shown by Plat recorded in Plat Book 179 at Page 25 in the office of the Circuit Clerk for the Western District of Craighead County in Jonesboro, Arkansas;

SECTION 2: A copy of the ordinance certified by the City Clerk shall be filed in the office of the Recorder of Craighead County, Arkansas and shall be filed in the deed records of such office.

SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above utility easements not necessary for the general benefit and welfare of the public; that the owners of all the property abutting the above utility easement is in favor of the closure and vacation of the above utility easement and that therefore an emergency is declared to exist and this ordinance shall take effect and be in full force from and after its p...
