AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF 3 PIECES OF USED EQUIPMENT FOR THE STREET AND SANITATION DEPARTMENTS.

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:
SECTION ONE: That the Street & Sanitation Departments of the City of Jonesboro, Arkansas needs to purchase a used 2006 Gradall , vin number 0210018056, a used John Deere 244J, vin number LU224JX722954 and a used 2004 CAT 953CLGP, vin BBX00283 .
SECTION TWO: That said equipment may be purchased from Equipment Connections, LLC of Jonesboro, for the sum of $195,000.00, $69,000.00 and $65,000.00 respectively less a trade in of the 595D John Deere for $3,500.00 to be paid from the Street Departments 2010 fixed assets accounts with no budget increases required.
SECTION THREE: That the City Council in accord with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Agent to purchase the above described used equipment for the price set forth in Section 2 above.
SECTION FOUR: It is further found that due to immediate need to acquire this equipment to replace existing equipment for ditch work and incinerator use, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect from and after its passage and approval.
