AN ORDINANCE TO AMEND SECTIONS 14.04 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS BY ADDING SECTION 14.04.13 FOR THE PURPOSE OF REGULATING YARD SALES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:    

 

SECTION 1: A Yard Sale shall be defined as the selling of miscellaneous goods such as, but not limited to, clothing and house wares on property zoned for residential or agricultural use.  Yard Sales are also commonly known as Rummage Sales, Garage Sales, and Carport Sales.  Such activities may take place inside or outside of a house, garage, or carport.

 

SECTION 2: Each property address shall be limited to four yard sales in a period of one year.  A maximum of two consecutive sale days shall count as one yard sale.

 

SECTION 3: Prior to holding a Yard Sale, the property owner or tenant shall notify the planning and inspection department by writing or telephone to register his or her yard sale.

 

SECTION 4: It is found and declared by the City Council that an emergency exists and this ordinance, being necessary for the preservation of the public peace, health and safety; it shall take effect and be in full force from and after its passage and approval.

 

SECTION 5: A violation of any provision of this Ordinance shall be punishable in accordance with section 1.32.01, general penalty, of the Jonesboro Municipal Code.
