AN ORDINANCE TO AMEND ORDINANCE NO. 954  KNOWN AS THE ZONING ORDINANCE PROVIDING FOR A CHANGE IN ZONING  BOUNDARIES.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
 
SECTION 1: That Ordinance No. 954 known as the Zoning Ordinance of the City of Jonesboro be amended as recommended by the Metropolitan Area Planning Commission with a change in zoning district boundaries as follows:
 
From Residential ( R-1 ) to Commercial ( C-3 ) of Lot 1A of Rees' replat of Lots 1 and 2  of Block "A", Spence Addition to the City of Jonesboro, Arkansas. (Robert Rees - Zolper)
 
This rezoning is subject to the following stipulations imposed by the Metropolitan Area Planning Commission and agreed to by the owner.
 
(1)   Owner shall dedicate an additional 20 feet of the utility easement which will make 40 feet of right-of-way from the center line of Caraway Road and a 20 foot utility easement;
 
(2)    The owner shall dedicate an additional 6 feet of right-of-way and five feet of utility easement to make a total of 41 feet of right-of-way and utility easement from the center line of Race Street:
 
(3)   The plat is to be changed to make the dedication and to correct existing right-of-ways;
 
(4)   The owner shall provide a site plan showing ingress and egress from the lot, etc.
 
(5)   The owner shall provide street improvement on Caraway Road when the property is developed, the same to be shown on the site plan.
 
SECTION 2: It is found and declared by the City Council that the proper use of the tract of land described in this Ordinance is being delayed because of improper zoning and therefore an emergency exists and this Ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its passage and approval.
