AN ORDINANCE TO VACATE AND ABANDON MACHINE ROAD

WHEREAS, a petition was filed City Council of the City of Jonesboro, Arkansas, asking the City Council to vacate and abandon the street designated as Machine Road which appears of record in Plat Cabinet "A" page 20 in the office of recorder of Craighead County, Arkansas; and
 
WHEREAS, after due notice, the City Council has heard all persons desiring to be heard on the issue and has ascertained that the vacation and abandonment of the street herein described will not adversely affect the public interest and welfare.
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of Jonesboro, Arkansas, that:
 
SECTION 1: The City of Jonesboro, Arkansas hereby releases, vacates and abandons all of its rights, together with the right to the public generally, in and to the street designated as Machine Road and as shown on the attached plat which is incorporated herein.
 
SECTION 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas, and shall be filed in the Deed Records of such office.
 
SECTION 3: The City Council of the City of Jonesboro, Arkansas, finds and declares that the above street is not necessary for the general benefit and welfare of the public, and that the owners of all the property abutting the above street and in favor of the closure and vacation of the above street.
 
SECTION 4: The City Council further finds and declares that an emergency exists and that this Ordinance is necessary for the preservation of the public peace, health, safety and welfare and shall take effect and be in full force and effect from and after it passage and approval
 
PASSED and ADOPTED this 17th day of July, 1989.
