AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CRAIGHEAD COUNTY/JONESBORO PUBLIC LIBRARY FOR THE REMITTANCE OF PROPERTY TAX COLLECTIONS; AMENDING THE 2005 BUDGET; AND DELARING AN EMERGENCY

WHEREAS, the Craighead County/Jonesboro Public Library (the Library) is currently funded by a 2 mill property tax levied by the City of Jonesboro; and
 
WHEREAS, such property taxes are currently collected by Craighead County and remitted to the library as collected by Craighead County; and
 
WHEREAS, the Division of Legislative Audit of the State of Arkansas has determined that the property taxes levied by the City of Jonesboro should properly be remitted to the City by Craighead County and subsequently remitted by the City as received from Craighead County to the Library, and
 
WHEREAS, the Division of Legislative Audit has further determined that a public service contract should be executed between the City and the Library for the remittance of property taxes as received by Craighead County
 
NOW THEREFORE, BE IT ORDAINED as follows:
 
SECTION 1: That the Mayor and City Clerk are authorized to enter into the public service contract included as an attachment to this Ordinance with the Craighead County/Jonesboro Public Library for the remittance of property tax collections received from Craighead County to the Library upon receipt from the County.
 
SECTION 2: That the 2005 Annual Budget for the City of Jonesboro is amended by the addition of $1,400,000 in revenues and $1,400,000 in appropriations for the estimated amount of 2005 property tax proceeds to be remitted to the library during 2005
 
SECTION 3: It is hereby found and declared that an emergency exists and that this ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage and approval.
