AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF A 1996 PS-130 CATERPILLAR PNEUMATIC ROLLER

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas:
SECTION 1: That the City of Jonesboro MATA Department needs to purchase the following:
1996 PS-130 CATERPILLAR PNEUMATIC ROLLER SERIAL # 7ND 514 WITH 690.5 HOURS
SECTION 2: That said equipment may be purchased from J. A. Riggs Tractor Co., Jonesboro, AR, for the sum of Twenty-Seven Thousand Five Hundred Dollars ($27,500). Said price includes delivery to Jonesboro, Arkansas, and shall include full power train warranty until May 3, 2001.
SECTION 3: That the City Council in accord with the terms of A.C.A. 14-58-302 (2) (b) hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described equipment for the price set forth in Section 2 above. Said amount shall be paid by money from the MATA Department’s Gravel Road Project line item in the MATA Department Budget.
SECTION 4: It is further found that due to immediate need to acquire this equipment an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage and approval.
