AN ORDINANCE TO AUTHORIZE THE MAYOR AND CITY CLERK TO ACCEPT AND EXECUTE MAINTENANCE AGREEMENTS FOR STORMWATER MANAGEMENT FACILITIES

WHEREAS, the Section 112-157 of the Jonesboro Municipal code requires a maintenance agreement assuring perpetual maintenance of Stormwater Management Improvements and drainage easements to be dedicated to the City be agreed upon by the City and the developer prior to final plat approval;
WHEREAS, the attached Maintenance Agreement for Stormwater Management Facilities has been reviewed by the City Engineer and City Attorney and is consistent with the Stormwater Management Regulations.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
SECTION 1: The Mayor and City Clerk are hereby authorized to accept and execute all future Maintenance Agreements using the attached Maintenance Agreement without any further action by the City Council.
