AN ORDINANCE TO ACCEPT THE BID BY J. A. RIGGS FOR A CAT 321C EXCAVATOR AND TO APPROPRIATE FUNDS

WHEREAS, the City of Jonesboro Street Department needs to acquire an excavator, and;

WHEREAS, bids were solicited for the purchase of said excavator.

NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas:

SECTION 1: That J.A. Riggs submitted the low bid for equipment meeting specifications, a Caterpillar Model 321c Excavator, in the amount of one hundred ninety-two thousand five hundred forty eight dollars ($192,548.00).

SECTION 2: That purchase price includes the trade in of a 1990 John Deere 790 DCL Track Excavator, Serial No. J008370.

SECTION 3: That bid includes both a three year and five year buy back option.

SECTION 4: That the Cat 321C LCR Excavator best meets the needs of the Street Department and the Public Works Committee recommends the purchase of said Excavator to replace the 1990 John Deere 790 DCL Track Excavator.

SECTION 5: That the money for the purchase of said Excavator shall be appropriated from the un-appropriated fund balance of the capital improvement fund dedicated to fixed asset acquisition.  The appropriation shall be added to the existing appropriation for line item 15-100-0431-00.

PASSED AND ADOPTED this the 6^th day of June, 2006.
