ORDINANCE TO VACATE AND ABANDON DANNY DRIVE

WHEREAS, a Petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 29th day of June 1977, praying to the City Council to vacate and abandon the street known as Danny Drive and particularly described as:
A parcel of land described as Danny Drive in the Brewer Addition to Jonesboro, Craighead County, Arkansas, said street running in a North South Direction and butting Lots 1 through 11 in said Addition, all as set out in the attached Survey and Plat.
Said street was plated and filed for record in Deed Record _____ page _____, of the records of the Jonesboro District of Craighead County, Arkansas, and;
WHEREAS, after due notice as required by law, the City Council of Jonesboro, Arkansas has set the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and ascertained that the street hereinabove described, has heretofore been dedicated to the public use as a street; has never actually been developed or used by the public in its entirety as a street for many years; that all the owners of property abutting upon the street to be vacated filed with the City Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street.
Now, therefore, be it ordained by the City Council of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the street described as follows:
A parcel of land described as Danny Drive in the Brewer Addition to Jonesboro, Craighead County, Arkansas, said street running in a North South direction and abutting Lots 1 through 11 in said Addition, all as set out in the attached Survey and Plat.
