AN ORDINANCE TO CLARIFY THE ENFORCEMENT AUTHORITY OF THE FLOOD PLAIN ADMINISTRATOR, CREATING A FLOOD PLAIN PERMIT, AND FOR OTHER PURPOSES

WHEREAS, the City of Jonesboro desires to clarify the enforcement authority of the Flood Plain Administrator and;

WHEREAS, FEMA has recommended adoption of enforcement guidelines.

NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro:

1) That the Flood Plain Administrator is specifically authorized to request conditional letters of map revisions when the Flood Plain Administrator determines the flood plain development may place citizens in harm’s way;

2) That anytime signature authority is required relating to any changes the Flood Plain Administrator is authorized to add comments, in addition to his or her signature.

3) The Flood Plain Administrator shall have enforcement authority to include but be not limited to:

A. Enforcement powers as are set forth for the Civil Engineer in Article 6, paragraphs 6.2, 6.3 and 6.5 of the Storm Water Drainage Design Manual and Flood Plain Compliance Guidelines as adopted by Jonesboro Code of Ordinances No. 3641.

4) There is hereby established a permit process for anyone desiring to perform work with in the Flood Plain. Prior to commencing a written applications shall be filed and a written permit obtained from the flood plain director. Said application shall be on a form and the permit issued pursuant to a form promulgated by the Flood Plain Administrator.

5) That the provisions of this ordinance are declared to be severable. In the event any portion or portions may be declared unconstitutional does not render the remaining provisions invalid

6) Further that there is a need for the immediate adoption of the provisions set forth herein for the protection of the citizens of the City of Jonesboro, the need to comply with FEMA regulations and to protect the integrity of the flood plain.
