AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF A 1993 JOHN DEERE EXCAVATOR

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas:
SECTION 1: That the City of Jonesboro MATA Department needs to purchase the following:
1993 JOHN DEERE 595D EXCAVATOR, SN 1301
SECTION 2: That said equipment may be purchased from Mahnen Machinery, located in Brunswick, Ohio, for the sum of Fifty-One Thousand Two Hundred Fifty Dollars ($51,250). Said price includes delivery to Jonesboro, Arkansas.
SECTION 3: That the City Council, in accord with the terms of A.C.A. 14-58-302(2) (b) hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described equipment for the price set forth in Section 2 above. Said amount shall be paid by money from the MATA Department's Gravel Road Project line item in the MATA Department Budget.
SECTION 4: It is further found that due to the immediate need to acquire the above equipment, an emergency is declared to exist and this ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect from and after its approval.
