AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF A 330CL CAT HYDRAULIC EXCAVATOR

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:

SECTION 1:  That the City of Jonesboro Street Department needs to purchase a 2005 Caterpillar 330CL12.10 Hydraulic Track Excavator SN Z1R02739.

SECTION 2:  That said equipment can be obtained from RIGGS RENTAL SERVICES, LLC, PO BOX 1399, LITTLE ROCK AR  72203 through BOEC for RIGGS RENTAL SERVICES, LLC at a cost of $154,533.60. 

SECTION 3:  That the City Council in accord with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described services for the price set forth in Section 2 above.

SECTION 4:  It is further found that due to the immediate need to acquire these services an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health, and safety shall take effect from and after its passage and approval.

PASSED AND ADOPTED this 4^th day of September, 2007.
