ORDINANCE TO VACATE AND ABANDON A PORTION OF HALTOM STREET BETWEEN RICHMOND AVENUE AND STEELE AVENUE

BE IT ORDAINED by the Mayor and Council of the City of Jonesboro, Arkansas:
WHEREAS, a petition was duly filed with the City Council of Jonesboro, Arkansas, on the 21st day of September, 1959, asking the City Council to vacate and abandon that portion of Haltom Street located between Richmond Avenue and Steele Avenue designated on the plat of Sloan’s Subdivision of Block “A” of Sloan’s Addition to the City of Jonesboro, now appearing in Plat Book 48, at Page 237, in the office of the recorder of Craighead County, beginning at Steele Avenue and ending at Richmond Avenue.
WHEREAS, after due notices as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street or the portion thereof hereinbefore described, has heretofore been dedicated to the public use as a street herein described; has never been actually used by the public generally, and especially for at least five years subsequent to the filing of the plat; that all the owners of the property abutting upon the portion of the street to be vacated have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street.
NOW, THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacated, and abandons all its rights, together with the rights of the public generally, in and to the street designated as follows:
That part of Haltom Street lying between Richmond Avenue and Steele Avenue in Sloan’s Subdivision of Block “A” of Sloan’s Addition to the City of Jonesboro, as shown by plat filed of record in Plat Book 48, at Page 237 of the records of the Jonesboro District of Craighead County, Arkansas.
