ORDINANCE TO AMEND ORDINANCE NO. 2173 PROVIDING FOR NOTICE TO REMOVE AND REMOVAL BY THE CITY OF ROTTING OR DEAD TREES

NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas;

 

SECTION 1: The first sentence of Ordinance No. 2173 Jonesboro Municipal Code 5.16.17 is hereby amended to read:

 

If the owner or occupant of any lot or other real property in the City of Jonesboro shall permit any weeds, grass, garbage, rubbish, rotting or dead limbs or trees or other thing or condition existing upon the property within 150 feet of dwelling or structure to become unsafe, unsightly, or unsanitary or maintain a condemned structure on the property, the Code Enforcement Officer shall give written notice by either hand or mail, certified addressee only to said owner and/or occupant to remove such unsafe, unsanitary or unsightly condition or condemned structure.

 

SECTION 2: All remaining portion of the ordinance will remain in effect.

 

SECTION 3: Due to the immediate threat of damage to life and property of the Citizens of Jonesboro caused by such falling limbs and trees, an emergency is hereby declared to exist, and in order to preserve the public health, safety and welfare, this Ordinance shall take effect from and after its passage and approval.
