RESOLUTION TO AUTHORIZE CONVEYANCE OF A WARRANTY DEED TO CARL BAJOHR CO.

WHEREAS, the City of Jonesboro, Arkansas (Lessor) and Carl Bajohr Co. (Lessee) have entered into a Lease and Agreement dated November1, 1969; and
WHEREAS, the Lessee desires to expand its facilities under the provisions of the afore-mentioned Lease and Agreement; and
WHEREAS, the Lessee desires to finance same in other than Act 9 bonds; and
WHEREAS, the Lessee has given proper notice to the Lessor of its intention of expansion; and
WHEREAS, under the provisions of the Lease and Agreement entered into by the parties provides that the Lessor will convey by General Warranty Deed to the Lessee the lands needed for expansion.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas that the Mayor and City Clerk are hereby authorized to convey by General Warranty Deed the necessary property requested in said expansion program to the Lessee and further authorized to enter into any necessary lease and agreements pursuant to the original Lease and Agreement dated November 1, 1969.
