AN ORDINANCE TO VACATE AND ABANDON AN UNIMPROVED DRAINAGE EASEMENT

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the drainage easement designated as follows with the exceptions listed in Section 2:
LEGAL DESCRIPTION
A drainage easement ten feet (10') in width, the west five feet (5') of which is along the east side of Lot 2A and the east five feet (5') of which is along the west side of Lot 2B in the Calvary Chapel Addition as shown by Plat titled, the Replat of Lots 1 and 2 of the Replat of Lot 3 of the Calvary Chapel Addition, Jonesboro, Arkansas, as shown by plat recorded in Plat Cabinet B at Page 149 in the office of the Circuit Clerk for the Western District of Craighead County in Jonesboro, Arkansas.
SECTION 2: A copy of the ordinance certified by the City Clerk shall be filed in the office of the Recorder of Craighead County, Arkansas and shall be filed in the deed records of such office.
SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above drainage easement is not necessary for the general benefit and welfare of the public; that the owners of all the property abutting the above drainage easement is in favor of the closure and vacation of the above drainage easement and that therefore an emergency is declared to exist and this ordinance shall take effect and be in full force from and after its passage and approval.
