AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF SPECIAL STREET SEALING WORK.

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:

 

SECTION 1: That the Street Department of the City of Jonesboro needs to purchase 21,500 gallons of reclamite, an asphalt rejuvenating agent, with the contractor providing all materials, equipment and labor to apply the materials where directed by the City in accordance with the manufacturing recommendations.

 

SECTION 2: That such street sealing work may be purchased from Pavement Recycling, Inc., 2541 Ranchito Street, Cape Girardeau, Missouri 63701, Howard E. Methany, President, for the sum of $51,500.00 total.

 

SECTION 3: That the City of Jonesboro shall be responsible for cleaning the streets in advance of contract work and for providing traffic control during the operation, with the contractor notifying the Public Works Director at least two (2) weeks prior to commencing the operation.

 

SECTION 4: That the City Council, in accord with the terms of A.C.A. Section 14-58-302 (2)  (B) hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described for the price set forth in Section 2 above.  Said amount shall be paid from the Street Contracts line item in the Street Department budget.

 

SECTION 5: Whereas, it is found that Pavement Recycling, Inc., is the sole known source of the above rejuvenating agent and that the conditions of many city streets are such that the safety of the citizens of Jonesboro may be in jeopardy, and emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its passage and approval.
