AN ORDINANCE TO WAIVE COMPETITVE BIDDING AND PURCHASE 10 X 7 BOX CULVERT FOR THE CLINTON SCHOOL ROAD CULVERT REPLACEMENT PROJECT AND DECLARING AN EMERGENCY DUE TO LIMITED PRODUCTION OF THIS SIZE BOX CULVERT

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
SECTION 1. . That the City of Jonesboro shall purchase of 10 x 7 Box Culvert from Scurlock Industries for the Clinton School Road Culvert Replacement Project for $371.20 per linear foot. That said sum shall be paid from Capital Improvements budget.
SECTION 2. That the City Council in accordance with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Agent to issue a purchase order for the above described for the price set forth in Section 1 above.
SECTION 3. It is further found that this is a time sensitive issue due to the limited production of this size box culvert, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage and approval.
