AN ORDINANCE TO ESTABLISH HOURS OF OPERATION FOR PUBLIC PARKS AND CEMETERIES WITHIN THE CITY OF JONESBORO, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF

WHEREAS, the City of Jonesboro wishes to establish hours of operation for city parks and cemeteries, and

WHEREAS, a need exists in the interest of public safety, convenience and necessity.

NOW THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro, that:

SECTION 1: All parks and cemeteries shall be closed from one half hour after sunset until one half hour before sunrise the following day.

SECTION 2: In parks which are controlled by gates or other devices, normal park hours are as posted except in the cases of pre-arranged, special group activities or regularly established concessions.

SECTION 3: The closing time of any park or cemetery, or any portion thereof, may be extended or shortened by the Director of Parks, Recreation and Cemeteries when necessary to accommodate or regulate any permitted activity.

SECTION 4: For purposes of security or public safety, the Director may exclude members of the public, on a temporary basis, from a park or cemetery or any portion thereof, including any trail or road, when it is determined by the Director, the Director of Public Safety, or the Mayor that such closing is necessary to protect public safety or public property. No person shall enter or remain in any park or cemetery, any portion thereof, or any trail or road that has been ordered closed.

SECTION 5: Whenever any area of any park has been reserved for the exclusive use of another, that area may be posted as being closed to the use of all other persons and persons not associated with exclusive use may thereby be prevented from using or entering that area of the park.

SECTION 6: No person shall enter or remain in any park or cemetery during the hours it is closed.
