A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF JONESBORO TO CONDEMN CERTAIN REAL PROPERTY LOCATED IN THE CITY OF JONESBORO AT 1205 W HUNTINGTON AVENUE FOR THE PURPOSE OF CREATING A DETENTION POND.

WHEREAS, the City of Jonesboro has the need to condemn by eminent domain certain property located within the City of Jonesboro located at 1205 W Huntington Avenue, Jonesboro, Arkansas for the purpose of creating a detention pond; And
WHEREAS, an offer of $60,500.00 has been made and refused by Antique Properties LLC dated February 11, 2008 refusing to sell their property located at 1205 W Huntington Avenue, Jonesboro, Arkansas more particularly described as follows:
Lot 3, Sachs Subdivision; also known as 1205 W Huntington Avenue.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:
Section 1: That the City of Jonesboro is hereby vested with the power of eminent domain and authorized under Arkansas Code Annotated 18-15-309 to condemn said property located at 1205 W Huntington, Jonesboro, Arkansas.
Section 2: This condemnation is necessary to obtain property for construction of detention ponds in the City of Jonesboro.
Section 3: This resolution shall take effect immediately upon its passage and approval.
