RESOLUTION AUTHORIZING THE LEASING OF PROPERTY LOCATED ON CHURCH STREET TO WILLIAM E. EBBERT

WHEREAS, in the platting of Belmont Addition in 1927, Church Street was shown as extending several hundred feet south of Highland Drive, but there has been no development making necessary the opening of said street, and there has been no improvement thereof; and

WHEREAS, there is a prospect of commercial use of the north 150 feet of the land west of said street as platted and immediately south of Highland Drive, but the project is conditioned on availability of said 150 feet of Church Street for the use of motor vehicles of patrons of the proposed business to be established just west of said 150 feet; and

WHEREAS, the proposed establishment will call for a substantial investment in construction cost, the employment of several people, an increase in taxes and a general improvement of the area; and

WHEREAS, the said tract of 150 feet north and southwest of Church Street as platted and immediately south of Highland Drive is owned by William E. Ebbert who has agreed to pave said street area 150 feet by 50 feet if permitted to use the same for motor vehicle traffic, including the parking of at least thirteen cars along the west line of said street, all to be according to plans and specifications approved by the City Engineer; and

WHEREAS, Section 19-2304 of Arkansas Statutes provides that cities have the power to vacate or lease out such portions of streets as may not for the time being be required for corporate purposes; and the Council of the City of Jonesboro hereby determines the said area of 150 by 50 feet of Church Street immediately south of Highland Drive is not now required for corporate purposes and that the proposed paving thereof by the said William E. Ebbert in exchange for a lease thereof will be of great advantage to the City and should be entered into;
