BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

SECTION 1: That Chapter 4. 04, Section 4. 04. 01 of the Code of Ordinances of the City of Jonesboro, Arkansas, is hereby amended by adding the following Subsection:

(A) State License Required. No city license shall be issued to any person or entity engaging in the business of a used auto dealer unless the same has procured a state license as provided by ACA Section 23-112-601.

SECTION 2: That Chapter 4. 04, Section 4. 04. 11 of the Code of Ordinances of the City of Jonesboro, Arkansas is hereby amended by adding the following Subsection: (C) Used Auto Dealer. Any person or entity engaged in the business of selling, offering to sell, soliciting, or advertising the sale of used motor vehicles which has been purchased by said person or entity for the purpose of resale, either or their own account or on behalf of another, either as their primary business of incidental thereto. The term “Used Auto Dealer” does not include:

(A) Receivers, trustees, administrators, executors, guardians or other persons or entities appointed by law or acting under judgment, decree or order of any court; or

(B) Public officers while performing their duties as officers; or

(C) Persons or entities whom are engaged in selling their own titled used motor vehicles which were acquired for purposes primarily other than resale to the public; or

(D) Motor vehicle auctioneers as defined by state law.

SECTION 3: If for any reason, any portion of this ordinance is held to be invalid, such invalidity shall in no way affect the remaining portions thereof, which are valid, but such valid portions shall remain in full force an...
