AN ORDINANCE TO VACATE AND ABANDON A UTILITY EASEMENT

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
 
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to a Utility Easement designated as follows:
 
Part of Lots 1, 2 and 14 of Block E of Dunwoody Huntcliff Estates revised to the City of Jonesboro, Arkansas being more particularly described as follows:  Begin at the Northwest Corner of Lot 2 of Block E of Dunwoody Huntcliff Estates revised to the City of Jonesboro, Arkansas; thence South 66º57'30″ East 185.79 feet to the point of beginning proper; thence North 22º00'00″ East 7.50 feet; thence South 66º57'30″ East 52.43 feet; thence South 14º58'03″ West 15.15 feet; thence North 66º57'26″ East 39.28 feet; thence South 22º00'00″ West 185.61 feet; thence North 68º00'00″ West 15.00 feet; thence North 22º00'00″ East 193.38 feet to the point of beginning proper containing 0.0823 acres (3586.40 square feet).
 
SECTION 2: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas and shall be filed in the Deed Records of such office.
 
SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above utility easement is not necessary for the general benefit and welfare of the public; that the owner of all the property abutting the above easement is in favor of the closure and vacation of the above easement and therefore and emergency is declared to exist and this ordinance shall take effect and be in full force from and after its passage and approval.
