AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF A TOYOTA FORKLIFT

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas:
SECTION 1: That the City of Jonesboro Street Department needs to purchase a 2002 Toyota 725 Forklift SN 67838.
SECTION 2: That said equipment can be obtained from The Lilly Company, 3613 Knight Arnold Road, Memphis, TN 38118 at a cost of $15,500. The price includes delivery to 628 Burke Avenue, Jonesboro, AR.
SECTION 3: That the City Council in accord with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described services for the price set forth in Section 2 above. To be funded from the Unappropriated Street Fund balance.
SECTION 4: It is further found that due to the immediate need to acquire these services an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health, and safety shall take effect from and after its passage and approval.
