MEMBERS ABSENT: None

The minutes of the April 10 and April 24, 1990 meetings were approved as prepared.

#1 OA90-1 A public hearing was held to receive comments on the proposed nonconforming use ordinance. This ordinance provides for change in uses, extensions of nonconforming used, allows reuse of nonconforming uses after uses have ceased, and provides procedures for restoration of nonconforming uses which have been damaged or destroyed.

Most of the comments received from those in attendance were related to the expansion of apartments. It was pointed out that the ordinance as prepared allows for expansion of apartments or any other nonconforming use by a maximum of 40%. A further statement was made that an expansion of a nonconforming use must be done in the same manner as the existing use. The 40% expansion would only be allowed one time. Concern was also expressed about the expansion of uses onto adjacent lands. NO ACTION was taken on this ordinance.

#2 OA90-3 A public hearing was also held to receive comments on an amendment to Ordinance No. 2257, which would allow for replacement of mobile homes, outside a mobile home subdivision, park, or court which have been made unusable by natural disaster or fire.

No comments were received by anyone in attendance.

#3 RZ90-9 M D R Cartage, Inc. Requested rezoning from R-1 to I-1 for 22.25 acres, more or less, located on a part of the SW 1/4, NW 1/4 of Section 9, T13N, R4E. The property is located on the east side of S. Caraway Rd., north of Arkansas Hwy.1.

A motion was made by Mr. Vance to approve this request subject to a total of 41' of right-of-way being dedicated from the centerline on Caraway Road and the owners participating in the street improvements on Caraway Road when it is improved. Mr. Coleman seconded the motion. Voting was 7 in favor, 0 opposed....
