AN ORDINANCE TO VACATE AND ABANDON A CERTAIN PORTION OF AN ALLEY IN BLOCK E OF GREGG’S SUB-DIVISION OF LANE’S ADDITION TO THE CITY OF JONESBORO, ARKANSAS

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
WHEREAS, a petition was duly filed with the City Clerk of the City of Jonesboro, Arkansas on May 6, 1957 asking the City Council to vacate and abandon all that portion of an alley in Block E of Gregg’s Sub-division of Lane’s Addition to the City of Jonesboro, Arkansas, as herein below more particularly described, and as same appears on the plat of Block E of Gregg’s sub-division of Lane’s addition recorded in deed record book 36 page 442 in the office of the Circuit Court Clerk and Recorder at Jonesboro, Arkansas, described as follows, to wit:
An alley being 20 feet wide by 350 feet long running East and West through Block E of Gregg’s sub-division of Lane’s addition to the City of Jonesboro, Arkansas, said alley being bound on the North by lots 1 through 14 inclusive, and on the South by lots 15 through 28 inclusive of said Block E.
WHEREAS, after due notice as required by law, the City Council has, at the time and place mentioned in said notice, heard all persons desiring to be heard on the question and has ascertained that the alley herein above described has heretofore been dedicated to the public use as an alley; and that same has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat; that all the owners of the property abutting to that portion of the alley to be vacated to have filed with the City Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Jonesboro, Arkansas:
