SPECIAL CALLED CITY COUNCIL MINUTES - JUNE 6, 1997

The Jonesboro City Council met Friday June 6, 1997, at 12:00 p.m. A full quorum was in attendance. Present were: Mayor Brodell, City Clerk, Donna K. Jackson, City Attorney, Phillip Crego and 10 council members. Those members were: Kelton, Rorex, Province, Kelly, Tate, Rega, Pratt, Fletcher, Bowers, and Roddy.

The following ordinance was on the third and final reading:

AN ORDINANCE LEVYING A TAX UPON THE GROSS RECEIPTS OF RESTAURANTS, CAFES, CAFETERIAS, DELICATESSENS, DRIVE-IN RESTAURANTS, CARRY-OUT RESTAURANTS, CATERING AND SIMILAR BUSINESSES IN THE CITY; PRESCRIBING THE PROCEDURE FROM THE COLLECTION AND ENFORCEMENT OF THE TAX; PRESCRIBING THE PURPOSES FOR WHICH REVENUES DERIVED FROM COLLECTION OF THE TAX MAY BE USED AND PRESCRIBING OTHER MATTERS PERTAINING THERETO

Councilman Bowers and Councilman Pratt questioned City Attorney, Phillip Crego if the ordinance needed to be amended to coincide with state law. Mr. Crego stated the language of the ordinance was broad enough, and an amendment would not be necessary.

Councilman Pratt inquired about a contingency plan to refund the tax, should it go to referendum vote. Mayor Brodell explained should a special election be held the tax would not be collected until confirmed by a vote of the people.

Councilman Rega moved, seconded by Councilman Tate to amend the ordinance in Section 1, changing the effective date from July 2, 1997, to July 6, 1997. A voice vote was taken resulting in all council members voting aye with the exception of Councilman Bowers who abstained from voting. Those members voting aye were: Kelton, Rorex, Province, Kelly, Tate, Rega, Pratt, Fletcher, and Roddy.
