RESOLUTION TO LEVY A TAX OF 1 MILL ON ALL REAL AND PERSONAL PROPERTY FOR THE PUBLIC LIBRARY

WHEREAS, on November 19, 1959, the Council of the City of Jonesboro passed resolutions for the levy of taxes necessary for the operation of the city government and other public agencies within the City, including the Jonesboro Public Library; and
WHEREAS, during the year 1959 there was a reassessment of all property in the City of Jonesboro for tax purposes, resulting in a substantial increase in the valuation of property subject to Millage taxes, and it was thought that sufficient funds for operation of the Jonesboro Public Library would be derived from a tax levy of five tenths on one mill upon the property in the City of Jonesboro, but it now appears that such levy would result in less revenue for the operation of the Library than has heretofore been available and that such reduced revenues would result in an impairment of library facilities, and it also appears from an opinion of the Attorney General of the State of Arkansas that Amendment No.30 to the Constitution of the State of Arkansas requires a continuing levy at the rate initially provided for by vote of the electors of the City on April 1, 1941, to-wit, one mill on the dollar, until changed by the vote of said electors, and there having been no such change by said electors, the Council was without legal authority to change said Millage levy.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas:
(1) Said resolution of November 19, 1959 is hereby annulled and set aside, and in lieu thereof, IT IS RESOLVED:
(2) That there be, and the same is hereby levied on all real and personal property within the City of Jonesboro, Arkansas, a public City Library tax of one mill on the dollar to be used for the maintenance of the public City Library for the year 1959 to be collected in the year 1960.
