AN ORDINANCE TO AMEND ORDINANCE NO. 1718, SECTION 1 AND SECTION 5, ALLOWING FOR THE UNDERGROUND STORAGE OF PROPANE, BETTER KNOWN AS UN1075, AND TO INCREASE THE MINIMUM CONTAINER SIZE TO TWENTY FIVE GALLONS

NOW THEREFORE BE IT ORDAINED by the City Council of the City of Jonesboro as follows:

 

SECTION 1: That Section 1 shall be repealed in its entirety and replaced with the following:  All persons, firms, corporations and/or associations are hereby prohibited from storing Class I flammable liquids and Class II or III combustible liquids and liquefied petroleum gases in tanks whether they be above or below ground on any residential lot, either single family or multi-family, within the municipal limits of the City of Jonesboro, Arkansas with the exception of propane, more specifically called UN1075,  which shall be stored underground only, in containers no larger than 1001 gallons.

 

SECTION 2: That Section 5 shall be amended by changing the words “twenty (20) gallons” to read “twenty five (25) gallons”.

 

SECTION 3: Due to the safety of Jonesboro residents an emergency is declared to exist, and this ordinance being necessary for the preservation of public peace, health and safety shall take effect and be in full force from and after its passage and approval.
