AN ORDINANCE TO APPROPRIATE MONIES RELATED TO THE CANCELLATION OF THE HIGHWAY 463 & 351 SIGNALIZATION PROJECT

WHEREAS, the City of Jonesboro, via Resolution 07:201 did consent to the initiation of a project to install a traffic signal at the intersection of Highways 463 (63B) and 351 and,
WHEREAS, it was later determined that this project was not desirable, and a request was submitted to the Arkansas State Highway and Transportation Department for cancellation of the project and,
WHEREAS, state funds were expended for engineering studies prior to cancellation, which must be repaid;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
SECTION 1: Resolution 07:201 is hereby rescinded; and,
SECTION 2: The City is hereby authorized and directed to execute all appropriate agreements necessary to cancel the project and,
SECTION 3: Funds in the amount of $ 20,979.44 are hereby appropriated for payment to the Arkansas State Highway and Transportation Department for reimbursement of funds expended prior to cancellation of the project.
SECTION 4: It is further found and declared by the City Council that an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its approval.
